    Default New CVS in Cochituate - Demolition Permit

    It is my understanding that an appeal has been filed with the ZBA asserting that a demolition permit to demolish Finnerty's in order to make way for the new CVS was improperly issued. Since it looks to me like Finnerty's has been completely razed, can anyone enlighten me as the reason for such an appeal. Thank you.

    Lawrie,

    I did a little research on this, and here is the answer based on my understanding:

    Bylaw 604.9.1 allows "parties of interest" to appeal a site plan with the issuance of any building permit (and a demolition permit is considered a building permit). I'm attaching a memo that the Building Commissioner (Geoff Larsen) sent to the Town Administrator (Nan Balmer) which explains it in more detail. So with the issuance of the Demolition Permit, appeal of the Site Plan (based on not complying with bylaws) is possible.
